STANDARD TERMS AND CONDITIONS OF SALE

Payment Terms

  1. 50% deposit of the contract value upon signing the agreement (non-refundable once production has started).
  2. 40% payment before installation begins, along with the required financial guarantees.
  3. 10% final payment after full delivery and signing of the handover report.
  4. The workshop reserves the right to suspend work immediately in case of delayed payment or failure to provide guarantees on time.

Delivery

  1. Delivery will take place within 40–60 days from the date of final measurement approval, confirmed in writing by both parties.
  2. Production will not commence before final dimensions and specifications are approved.
  3. The client has the right to visit the workshop to verify the readiness of the goods before providing financial guarantees for installation.
  4. If the client requests to postpone installation after goods are ready, storage fees will be charged at 5 OMR per square meter per month.

Changes and Cancellation

  1. Any change in dimensions, specifications, or colors after approval requires an additional agreement, including extra costs and time.
  2. If the order is canceled before production begins, an administrative fee of 10% of the contract value will be deducted.
  3. If the order is canceled after production has started, the advance payment (50%) is strictly non-refundable.

Warranty and Maintenance

  1. The workshop provides a ten (10) year warranty from the delivery date covering water leakage and hardware defects.
  2. The warranty does not cover damages caused by:
    1. Misuse.
    2. Accidents, shocks, or modifications by third parties.
    3. Severe climatic conditions (heat, humidity, storms, etc.).
  3. Maintenance under warranty is free of charge if the defect is covered.
  4. For damages caused by misuse or climatic conditions, a maintenance fee of 10 OMR per hour (minimum one hour) will be charged.

Obligations

  1. The workshop undertakes to make its best efforts to deliver high-quality products and services on time, but this shall not be considered a result-oriented obligation.
  2. The workshop shall not be held liable for delays caused by circumstances beyond its control, such as shortages of raw materials, supplier delays, customs issues, or force majeure events.

Client Responsibilities

  1. Provide a site ready for installation, free of obstacles.
  2. Allow technicians access at the agreed times.
  3. Sign the handover report immediately upon completion of installation.

Claims

  1. Any claim or objection must be submitted in writing to the workshop’s registered office within 8 days of goods delivery or service completion.

Governing Law and Jurisdiction

  1. All transactions and conditions are governed by the laws of the Sultanate of Oman.
  2. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Oman.
